TERMS AND CONDITIONS
- Survey invitations are strictly limited to one participant per household. Although subsequent survey completions may be received, only the first completion received from any person will count; subsequent attempts to enter by the same person or another member of the household will be disqualified.
- AMC reserves the right to disqualify any individual found to be: (a) tampering or attempting to tamper with the survey process, including but not limited to the survey invitations themselves or the completion of multiple surveys; (b) violating these Terms and Conditions; or (c) acting in a disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. In the event that an individual attempts to undermine the legitimate operation of a survey, AMC, in addition to disqualifying such person from participating in the survey, reserves the right to seek damages and all other available remedies (whether at law or equity) against him/her.
- By participating in a survey, all participants acknowledge and agree to release, discharge and hold harmless AMC, AMC's clients and their respective officers, employees, directors, shareholders, and agents from and against any and all claims, actions and or liability with respect to all aspects of the survey that may occur from participation in the survey.
- AMC assumes no responsibility for lost, late, misdirected, illegible, or mutilated survey invitations or completions or for any computer, online, telephone or technical malfunctions that may occur. AMC is not responsible for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilized in the survey or by any technical or human error which may occur in the processing of survey completions. AMC assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, survey completions. AMC is not responsible for any problems, failures or technical malfunctions of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, email, players or browsers, that results from technical problems or traffic congestion on the Internet or at any website or combination thereof. AMC is not responsible for injury or damage to participants or to any computer, related to or resulting from participating or downloading materials in a survey.
- AMC reserves the right to cancel, amend, withdraw, terminate or suspend the survey at any time and for any reason whatsoever, with no liability to you or any third party.
- By participating in this survey, you are deemed to have accepted and be bound by these Terms and Conditions.
- All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions, or the rights and obligations of participants and AMC in connection with the survey, shall be governed by, and construed in accordance with, the substantive laws of the Commonwealth of Pennsylvania without regard to conflict of law principles. All participants consent to the jurisdiction and venue of Montgomery County, Pennsylvania.
- Information collected from participants is subject to the AMC Privacy Policy located at http://www.amcsurveys.com/privacy.html.
- Surveys Involving Alcoholic Beverages.
Participants must be at least 21 years of age to participate in surveys involving alcoholic beverages and may be disqualified if found to be under 21. AMC is not an alcoholic beverage licensee and does not sell alcohol. The offer to participate in any alcohol survey is only available after a participant has already purchased, received a sample of the product(s) at an authorized tasting event or were exposed to promotional content for an alcoholic beverage from an authorized alcoholic beverage retailer. AMC is not responsible for any participant’s consumption of alcoholic beverages and participants may decline to consume any alcoholic beverages at any time. If you do choose to consume alcohol, please drink responsibly.
- Endorsements, Reviews, and Ratings (R&R)
The following governs your conduct and obligations, as well as AMC Global’s rights, regarding any Endorsements, Reviews, and/or Ratings (“R&R”) you may submit in connection with activities outside standard AMC Global research, including feedback shared after participating in product surveys or trials involving client products or services (“Products”).
Your Conduct & Obligations
When submitting a R&R, you acknowledge and agree to the following:
- Your R&R is authored and submitted by you, in good faith, after genuine participation in an AMC Global survey.
- Your R&R reflects your honest and personal opinion based on direct experience with the Product.
- You are at least 18 years of age at the time of participation.
- You discovered and purchased the Product independently, without incentive from AMC Global.
- You, not AMC Global, are solely responsible for the content of your R&R.
- You release, hold harmless, and indemnify AMC Global, its clients, affiliates, officers, directors, and employees from any claims, liabilities, or damages resulting from your R&R, including but not limited to claims of false advertising, copyright infringement, privacy violations, or defamation.
- You will not include personally identifiable information (PII) of yourself or others in your R&R, except for a first name or pseudonym if requested.
You further agree that:
- While we may collect certain personal data (e.g., email address) for verification or communication, this will not be published with your R&R without your explicit consent.
- You are not employed by or affiliated with any AMC Global client or their agencies in a way that could pose a conflict of interest. If you are, you must clearly disclose this relationship in your R&R.
- Your R&R is voluntarily provided and is not influenced by any prior offer of compensation or benefit. If you receive compensation (e.g., gift cards) for submitting an R&R, you must disclose this when your R&R is publicly shared.
- Your R&R complies with AMC Global’s research integrity standards and does not contain false, misleading, offensive, defamatory, or infringing content.
- Your R&R does not reference or compare other products, brands, or companies.
- Your R&R does not include malware, harmful code, or any content in violation of applicable laws or AMC Global policy.
You grant AMC Global and its clients a non-exclusive, worldwide, royalty-free license to use your submitted content for marketing, consumer insight, or promotional purposes.
- AMC Global’s Rights
- AMC Global does not guarantee the ability to edit or delete your R&R after submission.
- Except for authentication-related personal data, your R&R will be treated as non-confidential and non-proprietary.
- By submitting an R&R, you grant AMC Global and its clients (where applicable) a non-exclusive, worldwide, perpetual, irrevocable, royalty-free license to use, publish, adapt, translate, and distribute your R&R, in part or in full, through any media or platform.
- AMC Global may syndicate your R&R to its clients or third-party platforms, in compliance with privacy and disclosure regulations.
AMC Global reserves the right to:
- Decline to publish or remove any R&R that violates these Terms or applicable laws.
- Remove or redact any personal data included in an R&R to protect privacy and ensure compliance.
- Utilize third-party services or automated tools to authenticate, review, or moderate R&Rs to maintain quality and integrity.
Please note: The views expressed in R&Rs are solely those of individual respondents and do not represent the views of AMC Global or its clients.
